Man charged with murder of brother in south Forsyth

SOUTH FORSYTH — A Cumming man has been charged with murder in connection with the fatal stabbing of his brother early Tuesday in south Forsyth, law enforcement officials said. Mitchell Brown, 30, reportedly got into a verbal altercation with his older brother about 1 a.m. Tuesday at their parents’ home in the Long Lake subdivision off Peachtree Parkway, according to Epifanio Rodriguez, a spokesman for the Forsyth County Sheriff’s Office. When the fight turned physical, 36-year-old Stuart Brown suffered a fatal stab wound. The brothers’ parents were home at the time, according to Rodriguez. "Evidence on scene suggested that both alcohol and prescription drugs may have been a factor," Rodriguez said. "However, medical records and the results of the autopsy will determine if they were." He said Mitchell Brown is being held at the Forsyth County Jail without bond.

Teen arrested after firing shots during fight at south Forsyth gas station

SOUTH FORSYTH — A teenager suspected of firing a gun Saturday afternoon during a fight at a south Forsyth gas station was arrested Tuesday in neighboring Fulton County. Forsyth County Sheriff’s deputies obtained warrants for Tabitha Abigayle Smith, 18, of Roswell in connection with an incident that occurred Jan. 23 at the Shell gas station on McFarland Parkway just off Exit 12 of Ga. 400. According to Cpl. Robin Regan, a spokesman for the sheriff’s office, Smith has been charged in Forsyth with aggravated assault and reckless conduct. The fight happened about 5 p.m. At the time, witnesses told deputies they heard a gunshot, though no one was injured. Smith had supposedly come to the business to fight a 19-year-old from Roswell. Two other people, one from Roswell and the other from Alpharetta, were thought to have witnessed the incident. Smith reportedly left the scene before deputies got there. Regan said she is suspected of stealing the S&W Shield 9mm handgun she used in the incident from her parents’ home in Fulton County. The weapon was taken from her Jan. 23 before she fled the fight. The theft had been reported at 2:30 p.m. that day. Smith was released from the Fulton County Jail on Wednesday night after posting a $7,500 bond on a charge of theft by taking, according to jail records. According to Forsyth Sheriff’s Deputy Epifanio Rodriguez, Smith was then taken to the Forsyth County Jail, where bond has been set at $11,715.

Gainesville woman indicted for smuggling meth into new Forsyth County Jail

FORSYTH COUNTY — A Gainesville woman accused of bringing methamphetamine into the new Forsyth County Jail by smuggling it in her private area has been indicted for the incident. Mallory Faith Starley, 29, faces two counts in Forsyth County Superior Court in connection with her arrest on Sept 18, 2015, according to a bill of indictment from the grand jury. According to the report, Starley is accused of unlawfully possessing, with intent to distribute, methamphetamine, a Schedule II controlled substance. She then reportedly went inside the guard lines “established at the Forsyth County Jail with methamphetamine … in her possession without the knowledge and consent” of law enforcement. A female’s private area is not part of a routine booking search, which is why the drugs were not discovered until that moment, according to the sheriff’s office at the time of her arrest. If a deputy thinks a person may be concealing illegal items, he or she can be detained on the suspicion of drugs to be examined at the jail. At that time, Starley reportedly admitted to possessing the meth “with the intent to sell it once back in Gainesville.” Starley was not the only woman to attempt this smuggling method last fall. On Oct. 2, the day after a traffic stop for which she was arrested for possession of meth and use of drug-related objects, it was discovered that 24-year-old Kimberly Doris Ramey had reportedly smuggled some $700 worth of the drug into the new jail. Ramey, a north Forsyth resident, was charged with possession of meth with intent to distribute and crossing guard lines with a controlled substance. She has not yet been indicted.

Suspected burglar found near Cumming with Hank Aaron-autographed bats

CUMMING — A 32-year-old Loganville man was recently arrested on suspicion of burglarizing a home near Lake Lanier and taking, among other items, three baseball bats signed by famed Atlanta Braves slugger Hank Aaron. Michael Daniel Jones was charged earlier this month with first-degree burglary and probation violation, according to Epifanio Rodriguez, a spokesman for the Forsyth County Sheriff’s Office. A sheriff’s deputy reportedly saw Jones walking north on Pilgrim Point Road, east of Cumming, toward a nearby home while carrying two book bags and a garbage bag. The latter contained the bats, which were protected in clear tubes. The deputy reportedly knew Jones was on probation and thought his activity suspicious, so he stopped to chat with him. Asked about the bags, Jones supposedly told the deputy they weren’t his and that a friend asked him to pick them up from the side of the road. According to an incident report, Jones did not know the friend’s last name or where he lived. A name on the inside of one of the bags led deputies to a recently burglarized home on nearby Linger Longer Road. Due to his violation of probation, Jones is being held at the Forsyth County Jail without bond. He had been on probation since 2014, Rodriguez said, stemming from an arrest for driving under the influence. Jones also was arrested in August on a felony charge of theft by receiving stolen property.

Oakwood police: Suspects manipulate machine to steal lottery tickets

OAKWOOD — Not long after the largest Powerball drawing ever, three suspects in Oakwood are accused of manipulating a convenience store’s lottery ticket machine to get tickets without paying, police said. Oakwood Police are looking for three suspects who “used a device to manipulate the currency accepter on a Georgia Lottery machine.”“The subjects then left the Oakwood location and traveled to another convenience store located in Gainesville where they committed the same type of theft,” Oakwood Police said in a news release. The suspects are also accused of committing this type of theft in metro Atlanta stores. They were seen coming and going in an older model black Ford Expedition. Deputies fire at suspect during traffic stop in north Forsyth

NORTH FORSYTH — Law enforcement personnel fired shots during a traffic stop Tuesday night in north Forsyth that resulted in a man’s arrest and the seizure of money and suspected drugs, though no one was injured. The incident occurred about 10 p.m. at Jot Em Down and Gib Evans roads, just west of Ga. 400, when deputies pulled over 34-year-old Vanus Nichols of Cumming. Nichols is a reported drug dealer the Forsyth County Sheriff’s Office had been watching, said the agency’s Maj. Rick Doyle. According to Epifanio Rodriguez, a spokesman for the sheriff’s office, Nichols has been charged with aggravated assault on an officer and possession of methamphetamine. He is being held without bond at the Forsyth County Jail. Nichols was in possession of enough suspected meth to warrant a charge of intent to distribute. About $7,200 in cash was also found in the vehicle. During the course of the roadside investigation, two sheriff’s deputies and one Georgia Probation officer were forced to open fire on the suspect, Rodriguez said. The gunfire was in response to Nichols attempting to run over three deputies with his vehicle, Rodriguez said. He nearly hit one of the deputies, who in turn shot at him.“We shoot to stop a threat,” Rodriguez said. There is no evidence he fired back at the officers, Rodriguez said, though the incident remains under investigation. Nichols, who was traveling alone, was not wounded by the gunfire. As with any officer-involved shooting, the deputies have been placed on paid administrative leave while an investigation is conducted. The Georgia Bureau of Investigation is handling the matter.

NORTHWEST FORSYTH — Forsyth County Sheriff's deputies executing a search warrant Wednesday at a mobile home in northwest Forsyth found 27 dogs being held in what were described as deplorable conditions. The residence on Franklin Goldmine Road off Canton Highway (Hwy. 20) was discovered after a man showed up earlier that day at an area hospital in a bad — but unspecified — condition, according to Forsyth County Sheriff’s Cpl. Robin Regan. Hospital staff decided to alert the sheriff’s office based on what the man told them, Regan said, leading to the search warrant. One of the dogs was dead when deputies got there Wednesday night, according to Regan. It was not immediately clear whether a necropsy has been scheduled to determine the dog’s cause of death, said Epifanio Rodriguez, a spokesman for the sheriff’s office.“There was feces everywhere,” Rodriguez said of the home. “You could tell they were urinating inside.” Personnel from the county’s animal shelter took the surviving dogs — all Jack Russell Terriers — to the facility in north Forsyth, where they are being treated. Details about why the dogs were being held and to whom they and the house belonged have not been released. Charges are likely, officials said. The incident remains an open criminal investigation, though the man has not been officially named a suspect.

NORTH FORSYTH — Three more dogs have been rescued from a mobile home in north Forsyth where 27 other dogs were found Wednesday night in what were described as deplorable conditions. They were discovered Thursday inside the residence on Franklin Goldmine Road off Canton Highway (Hwy. 20) while Forsyth County Sheriff’s deputies returned with the second search warrant in as many days, according to Epifanio Rodriguez, a spokesman for the agency.“The conditions were so deplorable and cluttered, and with all the cracks and crevices, they very simply could have been hiding,” Rodriguez said. The three dogs were found in the same condition as the 26 others, which includes “varying states and stages of medical conditions.” All 29 dogs are Jack Russell terriers. The first search occurred Wednesday after a man had showed up earlier that day at an area hospital in a bad — but unspecified — condition, according to the sheriff’s office. Hospital staff decided to alert law enforcement based on what the man told them, Sheriff’s Cpl. Robin Regan said, leading to the search warrant. One of the dogs was dead when deputies got there. Officials said a necropsy to determine the dog’s cause of death will “more than likely not happen due to the level of decomposition” of the body. However, a veterinarian is expected to look at the remains and determine if one would be beneficial. The man, who was living at the house, has not been named as a suspect. The incident remains under investigation.“There is a likelihood charges will be taken,” Rodriguez said. Officials have not released details about why there were so many dogs in the home. Personnel from the county’s animal shelter took the surviving dogs to the facility in north Forsyth, where they are being treated. The 29 dogs are not available for adoption because they still belong to the man, who would first have to surrender them, said Jodi Gardner, spokeswoman for the county’s government. According to Rodriguez, a surrender of ownership must be ordered by a judge, who deems the man “incapable of taking care of these dogs.” Gardner said a veterinarian has seen the dogs.“Yesterday, overall, they appeared to be in good health,” she said.

NORTH FORSYTH — The man in whose mobile home in north Forsyth 30 dogs were rescued from what were described as deplorable conditions has been arrested in connection with the incident. Billy Ray Shirley, 59, was charged with 30 counts of animal cruelty by the Forsyth County Sheriff’s animal control unit for keeping the dogs inside the single-wide trailer on Franklin Goldmine Road, according to Deputy Epifanio Rodriguez, a spokesman for the agency. Shirley was released from the hospital about 6 p.m. Tuesday and was taken to the Forsyth County Jail, where he is being held on a $34,650 bond. The charges stemmed from a call the sheriff’s office received Feb. 3 from an area hospital, whose staff was concerned about remarks Shirley made. Shirley had arrived at the hospital “with complaints of stomach pains. Staff documented that he was covered in feces,” according to an incident report. The hospital staff who called the sheriff’s office said there were “even dead cockroaches stuck in the feces.” Shirley apparently explained he had more than 20 dogs in his home — though he was unsure exactly how many — and wanted to “find new homes for them.” The only two dogs he asked to keep were Blue, whom he said was his first dog and the mother of the rest, and Little Man. He said his backyard was missing a gate, so he could not let them out. Executing a search warrant at the home, deputies initially found 27 Jack Russell terriers, one of which was dead. About 10-12 thought to be 5 weeks old were found on a bed.“There was feces everywhere,” Rodriguez said of the home. “You could tell they were urinating inside.” Trash, broken furniture and feces could be seen in the yard and inside then home, according to the report. Three more dogs were found the next day during a second search.“The conditions were so deplorable and cluttered, and with all the cracks and crevices, they very simply could have been hiding,” Rodriguez said. They are not yet up for adoption, he said.“It’s up to us to take it before a judge who will determine if he is capable of taking care of these dogs,” Rodriguez said. “He can relinquish them himself. But if not then, it’s a matter of the court.” He said Shirley does not appear to have a prior history of animal cruelty with the sheriff’s office. The surviving dogs were taken to the county animal shelter in north Forsyth where, at last check, they were being treated and were in overall good condition.

Two arrested in cigarette caper at south Forsyth gas station

SOUTH FORSYTH — Two of the five men who reportedly swiped nearly 200 packs of cigarettes from a south Forsyth gas station in January have been arrested in Villa Rica for a recent similar incident, officials said. During an investigation at the Race Trac just north of McFarland Parkway/Exit 12 at Ga. 400, detectives found latent fingerprints that identified one suspect as 22-year-old Corey Hollingsworth, according to Forsyth County Sheriff’s Cpl. Robin Regan. A second suspect was identified as Marcus Strozier, 24. The men, both from Atlanta, are reportedly gang members who “have an extensive and violent criminal history.” When they post bond from the jail in Carroll County, in west Georgia, they will be transferred to the Forsyth County Jail, Regan said, unless another law enforcement agency has warrants out for their arrest. Warrants were secured in Forsyth County in connection with the cigarette-theft incident for robbery by intimidation. Further charges are pending as the investigation remains open. Hollingsworth and Strozier supposedly entered the south Forsyth gas station with three other men just before 4 a.m. on Jan. 14 in a black four-door car that had backed to the front of the business, Regan said. They were all wearing hoods pulled tightly around their faces to conceal their identities as they jumped over the counter, grabbing cigarette packs by tearing the racks and shelving off the wall. After being in the store for just more than one minute, they fled in the car toward Ga. 400. Regan said none of the suspects appeared to use a weapon during the incident.

2 indicted for home invasion, shooting of elderly woman near Cumming

CUMMING — Two Decatur residents have been indicted in connection with a February 2015 home invasion near Lake Lanier in which an elderly Forsyth County woman was shot twice while defending herself. According to an indictment report for Forsyth County Superior Court, Corey Sinclair Waithe, 26, and Samira Raheema Young, 29, face seven counts each, including aggravated assault, aggravated battery, first-degree burglary and theft by taking. The suspects are accused of breaking into a home on Magnolia Avenue, northeast of Cumming, on Feb. 2, 2015. When confronted by the 70-year-old homeowner, they reportedly shot her in the stomach and arm “with intent to murder.” The homeowner survived the gunshot wounds. However, they supposedly “did maliciously cause bodily harm” to her by rendering her hip and intestines useless. The suspects reportedly fled the home after taking a handgun, jewelry box and jewelry, according to the report. Waithe and Young also face three more counts within the same indictment for a second residential burglary on the same date in the county. A Grand Jury also indicted them on charges of first-degree burglary and theft by taking for reportedly breaking into a home on Lanier Heights Drive and stealing more than $5,000 in items, including another handgun and a laptop, television, cash and jewelry. Young turned herself in to Cobb County police on May 14 after learning she was wanted, according to Forsyth County Sheriff’s Cpl. Robin Regan at the time. She had been sought on charges of burglary, aggravated assault and aggravated battery in Forsyth, Cobb and Fulton counties. Waithe has been held in the Forsyth County Jail since Oct. 22, according to Epifanio Rodriguez, a spokesman for the sheriff’s office. He had previously been detained at the Fulton County Jail since March after he was shot several times by a homeowner during a similar crime in Atlanta.

Feds accuse Georgia prison guards of taking bribes, drug trafficking

ATLANTA (AP) — Dozens of Georgia prison guards agreed to protect drug smuggling operations for a high-level trafficker, believing their status as correctional officers would protect them from a vehicle search if they were stopped by police, authorities said Thursday. In exchange, they received thousands of dollars in bribes. But there was no big drug trafficker and the drugs weren't real. It was all part of a sting operation by the FBI. A total of 46 current and former correctional officers, as well as two civilians and one inmate, were arrested Thursday in the latest phase of an undercover federal investigation targeting contraband and criminal activity in the state's prisons, authorities said. Since September, about 130 people — including prison employees, inmates, former inmates and others accused of helping them — have been indicted in the effort known as Operation Ghost Guard. The investigation began when the FBI traced a scam — in which people around the country received phone calls saying they had missed jury duty and they could either pay a fine or be arrested — to Georgia prison inmates using contraband cellphones. That led them to look at how the phones were getting in, and they zeroed in on guards who were smuggling in phones and other contraband in exchange for bribes, said FBI Supervisory Special Agent Dan Odom. It snowballed from there. Corrupt guards saw an opportunity to get more money, and the scheme was hatched to protect the purported drug trafficker, who was supposedly moving kilograms of cocaine and methamphetamine from one part of the state to another, Odom said. A majority of those charged in the latest round of indictments agreed to wear their uniforms while accompanying the purported drug trafficker or while transporting the drugs themselves, believing that would shield them from law enforcement interference, the indictments say. "Corruption is all about how much money can I make from my position," Odom said. The indictments resulting in the arrests Thursday were filed over the last three months and unsealed Wednesday. The officers charged worked at nine different prisons. The corruption ran so deep that five of the guards arrested were on the Department of Corrections' COBRA tactical team, which is tasked with investigating and preventing drug trafficking and criminal activity and contraband inside the prisons, U.S. Attorney John Horn said. Given the magnitude of criminal activity in the Georgia prison system, the solution is not arrests and prosecution alone, he said. "These are systemic problems that were uncovered in these cases and they're going to require more comprehensive solutions," Horn said. The expenses for the investigation reached nearly $1 million in taxpayer money, said agent Britt Johnson, who heads the FBI's Atlanta office, all to investigate and indict people who were already in prison and corrupt officers responsible for overseeing them. One of the biggest challenges is attracting and retaining quality correctional officers for a tough job with low pay and marginal benefits, said Department of Corrections Commissioner Homer Bryson. The department has a job vacancy rate of about 30 percent and a turnover of about 2,000 officers a year, he said. Bryson added that he's working with the governor and Legislature to get more money set aside that will allow for higher starting salaries and promotional pay.

$566K in drugs seized during Gainesville bust

GAINESVILLE — A Gainesville man faces drug charges in connection to an estimated $566,000 in suspected methamphetamine and marijuana, according to authorities. Walter Xavier Flowers, 25, was arrested Thursday by members of the Multi-Agency Narcotics Squad and Gainesville police.“Agents arrested Flowers without incident as he arrived at a pre-determined location in the 1900 block of Jesse Jewell Parkway,” MANS Lt. Scott Ware wrote in a news release. Authorities said they seized 5 ounces of suspected methamphetamine and two Glock pistols from Flowers. The narcotics squad then moved to Flowers’ home in the 2300 block of Pine Grove Road in Gainesville.“During the search of the home, an additional (15) ounces of methamphetamine was located as was three growing marijuana plants and three additional firearms,” Ware said. Two rifles and a shotgun also were seized. The estimated value of the drugs seized between both places totaled $566,000. Flowers was booked in to the Hall County Jail, where he remains. He is charged with trafficking and possessing methamphetamine with the intent to distribute, manufacturing marijuana and five counts of possession of a firearm during the commission of a crime.

Domestic violence bill moves to state House

ATLANTA — A bill to hold repeat offenders of family violence more accountable recently passed the Georgia Senate with unanimous support and awaits a vote in the House of Representatives. Senate Bill 193 would make a first charge of family violence battery a felony if the offender has been charged with a similar violent family act before, whether in another state or in a charge that was eventually pleaded out. According to District 27 Sen. Michael Williams, a Cumming Republican who represents most of Forsyth County, the bill stemmed from an incident in which a man beat his wife to death and was convicted of manslaughter. However, as part of the deal he made with the prosecutor, the domestic violence charge was dropped in exchange for him pleading guilty to manslaughter.“He served his time, and then he got out and he beat another women after that,” Williams said. “Not to death, fortunately, but because on his first conviction they dropped the domestic violence off, they couldn’t treat that second as a felony. So they could only charge him with a misdemeanor.” This bill, sponsored by District 54 Republican state Sen. Charlie Bethel, will make a repeat offender more likely to be charged with a felony, no matter a previous plea bargain. Williams said a position in the Georgia Republican Party caucus is to protect women and children.“I really don’t see how anybody can vote against that,” he said. Shandra Dawkins, executive director of Family Haven of Forsyth County, a nonprofit shelter and women and children who are victims of domestic violence, said she supports the bill.“It would help close a gap in existing Georgia law and give prosecutors more tools to hold repeat domestic violence offenders accountable,” she said. Dawkins added that legislation like this is a first step to better protection that should also include longer probation terms.“We must not be driven from a reactive framework and wait for a crime to be committed,” she said, “but begin to explore a more proactive approach to work toward eradication of family violence in the lives of victims of domestic violence and those at risk of abuse.”

Vehicles targeted along Cumming retail corridor

CUMMING — A string of car break-ins last week along Market Place Boulevard in Cumming left several drivers with broken windows and missing belongings after they went shopping or to dinner. According to a series of incident reports from Cumming police, eight vehicles were targeted between 6:30 and 9:30 p.m. Feb. 10, apparently by the same suspect or suspects. Complainants who reported the incidents were parked at PetSmart, Outback Steakhouse, Provino’s Italian Restaurant, Michael’s, Longhorn Steakhouse and Taco Mac, all of which are along Market Place, a bustling retail corridor near Ga. 400 in Cumming. Nothing was taken from half of the vehicles, though the cars themselves were damaged in the break-in attempts. Most of the vehicles had the rear passenger window, which was facing away from the buildings, smashed. Some also had door handles and seals damaged by an apparent attempt to pry open locked doors. Only one vehicle was not damaged because it was unlocked. Items taken from the vehicles included backpacks, laptops, tax information, a GPS unit and ammunition. Video surveillance was not available at most of the locations, though police did remove a center console from one vehicle to find fingerprints. No suspects have been named in the case, which remains open.

Driver charged with DUI after hitting ambulance on Hwy. 20 east of Cumming

EAST FORSYTH — A 31-year-old Cumming man was arrested on suspicion of driving under the influence after his vehicle reportedly struck a non-emergency transport ambulance. Christopher Don Moss was pulled over by a Forsyth County Sheriff’s deputy between 11 p.m. and midnight Feb. 11 in front of Fire Station 15 on Buford Highway (Hwy. 20). Moss was eventually cited for DUI, failure to maintain lane and possession of open alcohol container by driver. According to an incident report, the deputy stopped Moss after the suspect reportedly failed to yield to an emergency vehicle while driving a 1999 Ford Mustang. However, the deputy soon discovered the ambulance had signaled for the Mustang to turn into the fire station as a result of the collision, said Epifanio Rodriguez, a spokesman for the sheriff’s office. No injuries were reported in connection with the incident, though both the Mustang and the ambulance received “slight damage,” Rodriguez said. During a search of the Mustang upon Moss’ arrest, an open 40-ounce Budweiser was found in the front passenger seat. He was taken to the Forsyth County Jail and posted a $3,960 bond the next day, Rodriguez said. According to the incident report, Moss had reportedly pulled out of the QT gas station just east of the fire station and straddled the lane.“It appeared [Moss] was entering the left lane but instead moved back into the right lane of travel, striking the ambulance,” the report said. This is the second accident involving an ambulance in Forsyth County in three months. On Dec. 11, a 40-year-old man was charged with driving without a license and failure to yield right of way to an emergency vehicle after turning in front of an ambulance with its lights and sirens running on Ga. 400 at Settingdown Road in north Forsyth. The ambulance was likely totaled, officials said at the time. No one was injured in the incident, including the two people in the ambulance. The ambulance in the Hwy. 20 wreck is not under contract with the county, according to Forsyth Fire Division Chief Jason Shivers. Central EMS, which is the ambulance service that took over the county contract about a month ago, has a “sizeable” non-emergency transportation fleet with a number of contracts with various area hospitals and doctor offices, Shivers said.“Other than the fact that this ambulance was based out of Northside Hospital, which is in Forsyth County, it has nothing to do with us,” he said. Therefore, according to Shivers, the incident did not cause any delay in response to 911 calls.

DAWSONVILLE — A 43-year-old Cumming woman is behind bars after authorities say she spiked her Waffle House co-worker’s drink with methamphetamine. Sonserea Dawn Evans has been charged with possession of a controlled substance with intent to distribute and aggravated battery. Both charges are felonies, according to authorities. As of Wednesday morning, a bond amount had not been set. Dawson County Sheriff’s Capt. Tony Wooten said authorities were called to the eatery on Hwy. 53 about midnight on Dec. 23, after a call was received that a 37-year-old male employee was having a medical emergency. The man was taken to an area hospital in what was described as serious condition, according to Wooten.“He is still under medical care is my understanding. It is also my understanding that at one point he was in a comatose state and required a feeding tube and ventilator,” Wooten said. Following the man’s hospitalization, law enforcement was notified that a video existed that showed the man’s drink had been drugged, according to authorities. Waffle House management turned the video over to law enforcement.“The video appeared to show Evans take her co-worker’s drink toward the bathroom area of the restaurant when he went outside, then shows her returning it and him drinking it,” Wooten said. Evans’ motives remain unclear, according to Wooten, as she is not cooperating with the investigation. Wooten said additional charges are possible, pending the man’s recovery.

Trial set to begin Monday in South Forsyth grad’s slaying

DAWSONVILLE — The alleged triggerman in the death of a popular youth recreation coach with Forsyth County ties is set to stand trial on Monday. Herman James Seppenfield VII, 51, has pleaded not guilty to the charges of felony murder, malice murder, aggravated assault and possession of a firearm during the commission of a felony. The charges stem from a Nov. 22, 2014, fight on Whitney Place off Dawson Forest Road in southeastern Dawson County that ended in gunfire. Brandon Weaver, 37, of Dawsonville was hit twice at close range, once in the chest and once in the side. The father of three and 1995 South Forsyth High School graduate died at the scene, a short time after first responders arrived. Authorities say Seppenfield fired the deadly shots. He has been in Dawson County Sheriff's custody since his arrest on Dec. 6, 2014. The fight reportedly started when Weaver and another man, identified as Marty Buice, arrived at the home to confront the people living there. Authorities said Weaver's son had been at a birthday party at the house several hours earlier that evening and had called home to say he wanted to leave. Also arrested in connection with the fight was 25-year-old Tory Jude Miguez, 25, who was charged with aggravated assault and possession of a firearm during a felony crime. During a court calendar call last month, it was confirmed that Miguez's case would not be heard until Seppenfield's trial was complete. In September, Superior Court Judge Jason Deal granted a motion filed on behalf of Seppenfield to sever his proceedings from those of Miguez. According to court records, attorneys for Seppenfield have indicated they want a change of venue for the trial. "Local and statewide newspapers have published and circulated articles describing the acts with which [Seppenfield] is charged, and such reports have included significant portions of documentary and hearsay evidence to defendant, the admissibility of which has not been considered by this honorable court," according to the motion filed May 15 by attorney Richard Stepp. Similar reports have appeared online and been broadcast on radio and TV in Dawson County and surrounding areas, which he said "has the potential of severely prejudicing" his client. On Sept. 3, Deal granted Seppenfield's motion to reserve the right to move for a change of venue if one cannot be seated locally. Weaver’s survivors include his wife, three young sons and numerous family members and friends throughout many communities. According to his obituary, Weaver graduated from South in 1995. Forsyth County News records show he was a member of the newspaper’s 1994 All-County football team as a defensive end. Weaver then went on to play football at Georgia Military College in Milledgeville and then Dakota Wesleyan University in Mitchell, S.D.

24 arrested across northeast Georgia in alleged $9.5 million drug ring

GAINESVILLE — Law enforcement agencies across northeast Georgia have arrested 24 people suspected in a $9.5 million drug trafficking ring. The Appalachian Regional Drug Enforcement Office worked for 10 months with the Stephens County Sheriff’s Office, the FBI and other agencies to break up Horace Mayfield’s alleged drug trafficking organization, according to authorities. Officers from 200 agencies, including the Forsyth County Sheriff’s Office, became involved with the investigation.“Mayfield and his drug trafficking organization have been operating in Stephens County and surrounding communities for many years,” according to a news release from the drug enforcement office.“Over the course of this investigation, the Mayfield drug trafficking organization can be attributed to 72 kilograms of cocaine, 15 kilograms of methamphetamine and 50 pounds of marijuana with a total street value of ($9.5 million).” The agents were serving 20 search warrants in addition to 27 arrest warrants. The network allegedly spread from Atlanta up into South Carolina. Sheriff’s offices from Forsyth, Hall, Habersham, Lumpkin and White counties contributed to the investigation. According to Sheriff’s Cpl. Robin Regan, one local deputy served on the Georgia Bureau of Investigation’s task force. Regan deferred additional comment on the deputy’s involvement to the GBI. The news release stated that additional arrests are expected.

Man killed in go-kart wreck near Cumming Fairgrounds

CUMMING — A Roswell man driving a racing go-kart on Castleberry Industrial Drive near the Cumming Fairgrounds died after it struck another vehicle head on about 5:30 p.m. Thursday.   According to the Forsyth County Sheriff's Office, 27-year-old John Cory Brown was traveling west on Casteberry Industrial Drive when the go-kart collided with the other vehicle, which was heading east.   The crash occurred as the go-kart was coming out of a sharp curve in the road.   Brown was taken by ambulance to North Fulton Hospital, where he later died.   The driver of the other vehicle was not injured. The crash remains under investigation, and no charges have been filed. It was not immediately clear why the go-kart was on the road, though there is a quarter midget race track at the nearby fairgrounds.
