BUFORD -- A Buford woman was indicted and charged last week in the 2015 shooting death of her husband, a case previously considered to be a suicide, police said. Liubov Volkova, 35, is charged with murder in the death of her husband, Jordan Whitson, 38. She was booked Friday in to the Gwinnett County Jail. Gwinnett County Police responded around 1:30 a.m. Nov. 1, 2015, to the 2500 block of Hampton Park Drive in Buford, where Volkova told the dispatcher “that her husband just shot himself in the cheek,” Cpl. Michele Pihera wrote in a news release.“The wife, Liubov, met the officers at the door and told them where they could find her husband inside the home,” Pihera wrote. Whitson was unresponsive on the stairs and died as a result of his injuries. According to the initial report, two officers performed a sweep of the house and found no one inside other than an infant in the nursery. The officers handed the child to Volkova.“(Volkova) told the officers where she secured the gun prior to their arrival,” Pihera wrote. Pihera said specific details about the investigation would not be released, but the detective “does not believe the gunshot was self-inflicted,” she said.

LAKE LANIER – The Alpharetta Department of Public Safety has confirmed that one of their officers has been charged after being involved in a weekend boating incident on Lake Lanier that left one man seriously injured.  According to a statement by George Gordon, a spokesman for the agency, the officer was charged with boating under the influence by the Georgia Department of Natural Resources. The officer has been identified by the Forsyth County Sheriff’s Office as Christopher James Harrison. Harrison was taken to the Forsyth County Jail after being arrested, where he posted a $2,750 bond on July 3. According to a GoFundMe page set up by family and friends, the victim in the incident, Josh Akins, a former police officer and military veteran, was very seriously injured. Citing the fact that Harrison had been absent from the department on military leave since March 23 and was under military control and jurisdiction, Alpharetta declined further comment. Gordon said Alpharetta will open an internal affairs investigation into the incident.

Former Cumming police officer indicted in federal court for fraud, accepting bribes

CUMMING – A former officer with the Cumming Police Department was arraigned in a federal court after being charged with wire and computer fraud. Nathan VanBuren, 34, is accused of taking money from someone who was arrested by Cumming police in July 2015 and accessing the law enforcement database to provide search results to that person.“This former police officer allegedly used his position to access sensitive information in exchange for money,” said U.S. Attorney John Horn. “This type of conduct unfortunately impairs the hard work of the police as well as the community’s trust in law enforcement.” According to information presented in court, VanBuren responded to a 911 call at a person’s home in Cumming in July 2015 in his “official capacity as a police officer.” The person was arrested. In July and August of last year, he and the person reportedly had “additional communications.” VanBuren allegedly asked the person for a loan because his wages were being garnished and he had incurred financial debt from medical and surgical expenses for his son.“In reality, VanBuren’s salary was not being garnished and his son was not ill. The citizen reported VanBuren’s actions and agreed to cooperate with law enforcement,” according to information from the U.S. Department of Justice in the Northern District of Georgia. The person provided VanBuren $5,000 in response to the former officer’s “repeated requests for money. During that meeting, the citizen asked whether VanBuren would search a sensitive police database to determine whether an individual was an undercover police officer.” VanBuren reportedly accessed the database in exchange for $1,000 and provided the results of that search to the person.“Investigations into allegations of public corruption involving police officers is a disheartening, but very necessary duty of the FBI. People have a right to demand that their public safety officers possess integrity and a sense of fairness as they carry out their duties,” FBI Atlanta Special Agency in Charge J. Britt Johnson said. The Forsyth County News reported in September 2015 that VanBuren was the focus of an FBI probe. Cumming Police Chief Casey Tatum said at the time that the former officer resigned on Sept. 9, 2015, in lieu of termination. Tatum did not mention a specific crime at the time, but a memorandum he sent VanBuren on Sept. 3, 2015 – which the Forsyth County News obtained from the city in response to an open records request – said the department had received an “allegation of misconduct regarding you extorting money.” He was immediately placed on administrative leave with pay. The following day, however, he received another letter informing him that the city would be terminating his employment in five days, on Sept. 9. The letter cited three policy manual violations discovered during the criminal investigation: duty regarding conduct, conduct unbecoming and buying/selling/receiving items. The last violation, which would appear to be the most serious, is described as “buying, receiving or selling anything of value from or to any complainant, suspect, witness, defendant, prisoner, or other person involved in any case which has come to the attention of, or which arose out of, department employment.” The letter also listed violations of city personnel policies and procedures, including: misconduct; conduct reflecting discredit on the city or the employee’s department; acceptance of money or other valuable consideration given with the intent of influencing the employee; and improper use of official position for personal profit or advantage. A check of VanBuren’s personnel file, which the city also provided in response to the open records request, shows little sign of serious trouble leading up to the investigation. According to Cumming records, VanBuren joined the city police force in August 2008 and was promoted to sergeant in August 2013. He came to Cumming from Emerson, a small town in southern Bartow County, where he had worked as a police officer for more than two years. He had previously served in the U.S. Army Reserves. In October 2008, a Cumming police car driven by VanBuren was involved in a wreck that was determined to be his fault for failure to yield. He was responding to an emergency at the time. In December 2012, VanBuren received a memorandum for failure to follow chain of command involving a personnel matter. In March 2014, he served a seven-hour suspension without pay for failure to complete mandatory training sessions. And on June 6, 2014, VanBuren was among the public safety personnel who responded to the old county courthouse when a heavily armed gunman unsuccessfully attempted to storm it. Per department policy, he was placed on leave following the shooting and was cleared to return to duty 10 days later. He was arraigned before U.S. Magistrate Judge Janet F. King and was indicted by a federal grand jury on June 29. The case is being investigated by the FBI. According to Deputy Epifanio Rodriguez, a spokesman for the Forsyth County Sheriff’s Office, there is no record that VanBuren was booked into the Forsyth County Jail. Assistant U.S. Attorney Jeffrey Brown is prosecuting the case.

GAINESVILLE — Landrell Payne said “everything started from a scream.” Payne, the manager at Xtreme Clean Auto Spa on Browns Bridge Road, and employee Melvin Hall looked around noon Friday at the Gainesville business to intervene when a man attempted to hijack a woman’s car while her toddler was in the backseat. Eric Timothy Davidson, 27, of Gainesville, is accused in the incident, according to police. The woman was vacuuming her Toyota Yaris while her child was in a safety seat in the back of the car. Davidson allegedly fought with the woman, got inside the car and put it in drive, authorities said. Hall was drying off a truck when he heard a scream and saw the man walking away from the woman.“I’m running across the lot screaming at Melvin to stop that guy,” Payne said. The employees held Davidson in a headlock, Hall said, until police arrived. Police said Davidson was in possession of a quantity of methamphetamine and a revolver.“Some pretty tall guys were at the vacuum cleaner back there. They stepped over to help us out, too,” Payne said. Gainesville Police had been dispatched earlier to the Wal-Mart Neighborhood Market on Browns Bridge Road, where authorities said Davidson allegedly approached a man at the gas pumps. According to the warrants, Davidson is accused of demanding the man’s wallet, keys and cellphone by threat of a firearm in his pocket.Davidson was booked last week in to the Hall County Jail, where he remained as of Thursday. He has been charged with attempted kidnapping, attempted motor vehicle hijacking, attempted armed robbery, possession of a firearm during the commission of a crime and possession of methamphetamine.“I’m not a hero,” said Hall, who has been with the business for about six months. “I’m just a guy that didn’t want to see somebody hurt.”

WEST FORSYTH -- Residents of two neighborhoods in west Forsyth started their Independence Day holiday weekend off by realizing they were the victims of an overnight car break-in spree. An unidentified suspect apparently went driveway to driveway in the late night hours of Thursday, June 30 and the early morning hours of Friday, July 1, stealing items from unlocked vehicles in the Evans Farms and Legacy at Prather Farm subdivisions off Canton Highway (Hwy. 20) and Post Road (Hwy. 371). “We do get entering autos here, but a spree like that in one night is not typical,” said Deputy Epifanio Rodriguez, a spokesman for the agency. The weekend being a holiday where people often travel may have been a contributing factor, though this does not happen every year or every holiday. At least 17 incident reports were filed with the Forsyth County Sheriff’s Office, with some reports containing two vehicles entered at the same home. Incidents in Evans Farms were largely on Dartford Road and Idlewood Drive off Evans Road, which connects Hwy. 20 and Post Road. Reports made in Prather Farm were farther south on Post Road on Prather Farm Circle. Vehicles entered were “generally unlocked.” The suspect did not use force and did not damage the vehicles. Items stolen included wallets, purses, sunglasses, iPods, navigation devices, laptops and cash. Two victims’ credit cards were reportedly used at a Walmart in Lithonia at 6:30 a.m. on July 1, one of which was for a $1,000 purchase. Another victim’s losses from items inside a purse were valued at more than $1,900.“Always keep your car locked, no matter where you’re at,” Rodriguez said. “Don’t leave valuables in your car. People will not only keep their cars unlocked, but they’ll keep [belongings] as far as jewelry, cash and guns in their car.” He said residents who do keep their vehicles unlocked in their driveway overnight or anywhere else should keep items such as purses, money or firearms out of sight. A crime scene unit is investigating the incidents.“To my knowledge, we don’t have any suspects at this time,” Rodriguez said. Two incident reports described a neighbor’s surveillance footage that captured a man of an unknown race pull on his pickup truck’s passenger door handle.“The male does not attempt to force to gain entry” to the vehicle and “walks away on foot” from the resident’s house, according to the report.“It is unknown if there is more than one suspect in this case. That male was wearing a hooded jacket, half face mask, black pants, tennis shoes and gloves,” the report said. Rodriguez said anyone with information or any victims who have not yet filed a report can call the sheriff’s office at (770) 781-2222.

NORTH FORSYTH -- Two north Forsyth residents have been indicted for a handful of drug charges after deputies found 45 grams of suspected methamphetamine, 69 grams of suspected marijuana, other drugs and about $8,000 in cash in their vehicle during a traffic stop. Christina Marie Atwell and Stephen Butler, both 31 as of their initial arrest, face five counts, including trafficking in methamphetamine, possession of meth and marijuana with intent to distribute, possession of drug related objects and tampering with evidence, according to a July 11 indictment report. According to initial reports from the Feb. 20 incident, Atwell briefly attempted to elude deputies when they initiated a traffic stop on Dr. Bramblett Road. By the time they pulled her over, Butler, who was in the passenger seat, had reportedly thrown several plastic bags filled with drugs from the vehicle. Atwell’s son, who she said was nearly 3, was in the vehicle at the time and was picked up by her mother while the Division of Family and Children Services was notified.“I stepped to the vehicle to check on the child and spoke with him, and he was calm and playing with a toy,” the deputy stated in the report. Atwell and Butler told deputies that they were in a relationship and that she drives his car regularly, “which is supported by the fact that her child was in the backseat in a car seat surrounded by child care items, several makeup bags and her perfume in the driver’s door panel.” During the traffic stop, the deputy who pulled the vehicle over called for backup after seeing “a digital scale on the drivers’ floorboard and a large amount of U.S. currency under Mr. Butler’s left thigh.” The officer who responded as backup found “multiple plastic bags” with “bags consistent with the packaging of narcotics,” the report said. The bags were in the road, where the vehicle had reportedly attempted to elude the patrol car. Deputies also recovered “a large Tupperware container, and inside the container was a plastic bag with a large amount of methamphetamine, a plastic bag with a large amount of marijuana and a Marlboro menthol cigarette pack.” The report continued, “Inside of the cigarette pack was a small personal-use amount of methamphetamine, and Mr. Butler had an identical brand and style of cigarette pack in his pocket, tying him to the container.” The Tupperware was found on the right side of the road, “which supports Mr. Butler throwing the container and bags out of his window,” according to the report. When the deputy pulled the car over, the passenger side window was “rolled completely down.” He stated in the report that this “stood out to me because the windows had been rolled up when the vehicle passed and indicated to me that something had possibly been thrown from the vehicle.” Atwell supposedly dropped a marijuana pipe in the grass outside of the vehicle, which was found “later.” The money found was reportedly on the passenger seat and separated by denomination with rubber bands. A “second large amount” of cash was found in the center console, also banded and separated. The two makeup bags in the vehicle supposedly contained “a used methamphetamine pipe, rolling papers, two empty sandwich bags, two Xanax pills and one soma pill and two marijuana smoking devices.”“In the backseat next to where the 3-year-old child was seated was a false compartment dictionary, which contained marijuana and methamphetamine residue,” the report said. Other drug-related objects and money was found throughout the vehicle. Forsyth County Superior Court Judge David L. Dickinson is presiding over both cases.

CUMMING -- Josephine Jefferson credits a miracle for saving her grandchildren’s’ lives when a car drove through the back wall of her family’s home on Beacon Ridge at about 5 p.m. Saturday afternoon. Jefferson said the kids, along with their father, had just come to her side of the duplex when the car came crashing in off Hutchinson Road behind Lakeland Plaza on July 23.“We had a man doing some work, and he’d come over so we could talk about that,” she said. “Thank God the children weren’t in the house.”The car smashed through the back wall of the house. My son almost left the baby home in the crib, and it ended up underneath the car," said Jefferson.  “It pushed over the couch and landed on the fireplace,” Jefferson said. The Forsyth County Fire Department Technical Rescue team responded and used wooden timbers to shore up the back of the structure, which is now missing about a third of the back wall.“Those men are angels. I didn’t know they did things like this,” said Jefferson as she waved goodbye to the firefighters after they’d finished. Jefferson said there were young people in the car and that she understood that one may have been teaching the other how to drive, using the quiet cul-de-sac roads inside the subdivision for practice. According to Deputy Epifanio Rodriguez, a spokesman for the Forsyth County Sheriff’s Office, Melvin Oxlaj, 17, crashed his Toyota Scion at a “high rate of speed.” His two passengers were reportedly his brothers who were teaching him how to drive. Oxlaj was charged with reckless driving, failure to maintain lane and driving without a valid license. He was detained in the Forsyth County Jail and posted a $2,535.50 bond later that day. One of his brothers, who owned the vehicle, was cited for allowing an unlicensed person to drive. The American Red Cross responded to assist the family with finding a place to stay while the damage to the home is evaluated.

FORSYTH COUNTY -- While Forsyth County juveniles may not be any more delinquent than others in the state, with nearly a third of the population under the age of 18, the county’s juvenile court is seeing more traffic and increasing caseload demands, calling for more judges in the system. Randall Meincke was recently appointed as the first full-time Associate Juvenile Court Judge for Forsyth County. He previously served part-time in the position and will be the county’s 10th full-time judge, joining Chief Juvenile Court Judge J. Russell Jackson as the court’s only other full-time judge.“This is another milestone demonstrating the significant improvements in our judiciary’s ability to process and dispose of the ever-scaling caseload in Forsyth County,” Jackson said. Meincke will be sworn in on Friday, Aug. 5 at 11:30 a.m. at the Forsyth County Juvenile Courthouse Annex. Jackson and Chief Superior Court Judge Jeffrey S. Bagley will officiate the ceremony. Meincke’s appointment comes in response to Forsyth County’s exploding population and the large number of child and teen residents. In the last 15 years, the county’s population has more than doubled — from 98,407 residents in 2000 to 212,438 in 2015 — currently making Forsyth County the fastest growing in the state and ranking 11th in the nation for population growth over the last five years. From April 2010 to July 2015, the county’s population grew 21 percent, according to a U.S. Census Bureau report. In addition to hearing cases, Meincke will assist in future development projects aimed at identifying causes of delinquent and dependent behavior as well as programs designed to positively respond to the needs of the communities’ at-risk youth and families. While initiatives such as the Teen Interception Program — a seven-week, two-hour-a-week class run out of the Forsyth County Sheriff’s Office — have begun such work, there is more to be done.“I have seen firsthand the real needs of our community,” Jackson said. “The lives of the children in our community are precious and the problems children face, whether delinquency or dependency, deserve our highest response and priority.” Bagley praised Jackson and also expressed confidence in Meincke’s appointment.“It is comforting to know,” he said, “that our juvenile court will continue to provide adequate access to justice for the citizens of Forsyth County. I have the utmost confidence in Judge Jackson and newly appointed Judge Meincke to dispense justice competently, fairly, and swiftly to all who come before their bench.”

CUMMING -- Officials on the scene of a Saturday afternoon crash on Canton Highway said a bicyclist was seriously injured when she was struck by a car.   Firefighters said the woman had very serious injuries and was taken to North Fulton Hospital. Officials had initially called for a medical helicopter but decided to transport her by ground ambulance instead due to the response time of the estimated helicopter. The cause of the accident, which closed Canton Hwy. (Hwy. 20) for about two hours on July 30, beginning just after 4 p.m., remains under investigation by the Forsyth County Sheriff's Office.
